Attorney ,MS. KASEY STERM questioning Mrs. Claire Anderson was unsettling similar to observing a Cain and Abel or a David and Goliath play out. And let me be clear. In the this realtime circumstance, ATTORNEY STERM DOES NOT FALL INTO THE CATEGORY OF HONORABLE CHARACTER.
➡️➡️MRS ANDERSON , you did an extraordinary job in testifying. Your testimony gave the public a strong impression you are a dignified, honest, and honorable woman.
I'll also state, the respondent's attorney MS. KASEY STERM, leaves the me, the public, with a sick feeling she is the predominant "shit stirrer" in this suit, and that includes her clients, the Davids. The respondent's attorney, MS. KASEY STERM,has unfortunately left example after example of being the "loathed,dirty, and unscrupulous"type of lawyer who twists comments and leaves impressions, not in an honest or good faith manner.
As a landscape designer, the respondent attorneys argument regarding the landscaping plans is so ridiculous and legally baseless. Landscape Designers look at potential work as potential income. One starts with the pie in the sky potential design and whittles the final plan to the client's budget. There is no way this attorney can prove the designer didn't simply make a mistake in misreading the acreage plans and easement agreement. To hold these owners to POTENTIAL landscaping plans,drawn by another party, is laughable. For an actual attorney to use such a baseless agreement in an opening statement says a whole lot about the this attorney's competence and the case she is defending.
The demeanor of your attorney is so critical in these sorts of jury trials. There is something about the respondent attorney which really rubs me the wrong way. Wondering if anyone else has the impression?
An easement is on the Deed on the property. If not there then there is no easement.

To be honest I would not get upset if the Nabors played hockey on the easement as long as they kept it clean.
These easement issues are crazy isn’t it one owned the land and the other has rights to use said land? This sounds like a nightmare to say the least

I am confused why the Davids even have an easement on the Andersons property – I thought an easement was intended for access to the street, but if it's completely overgrown and being used for "privacy", that doesn't fall under the intent of needing an easement and I would think it should revert back to the Andersons if it's not being used to access the street.
I haven’t finished the video yet but hopefully the attorney went to the county to get aerial views that go back through the years showing how the easements were not being used and maintained by the neighbors. Counties keep all those aerial views.
If you put your crap in someone else’s dumpster without prior authorization you are starting off on the wrong foot.
Mr Anderson spoke his mind and did so forthrightly, using vernacular that displease the plaintiff. However, Mr Anderson felt it aptly described how he felt about the plaintiff, who showed little insight that her behaviour and that of good neighbourly relations!!! 😂😂😂

What is the verdict? I've been watching for hours and need to know! Please, the lawyers talk about themselves and their billing process way too long, nobody cares, just need the verdict.
An easement usually pertains to some utilitarian need by the using party. Access to their property, parking, etc. These users seem to think they have a say in how the property owners want to maintain the easement area. They don’t. The “any legal activity” is pretty vague and I suspect at the heart of this dispute. Lesson: always make sure your contracts are very clearly worded.
Never make friends or enemies with a neighbor, keep to yourself and only call the police for emergencies. It's not 1950 where you could bring cookies to a new neighbor, people are crazy.
Not many things can get your hackles up more than finding out the property line isn’t where you thought it was.
That seems like the neighbors might be keeping bodies there. Seems like they might be worried about someone digging there. I would find out why there acting like that!

This comes down to the word "exclusive" used by the Davids' lawyer in discussion of easement use. Where did that come from and was it meant to exclude the Andersons as tax payers and owners of the land (of which I'm skeptical)? Is it in the easement paperwork? I'm shocked I'm nearly done watching this thing and nobody has even introduced the easement documents to address this. Instead we're talking about the n word…

Does this mean that the person using my easement needs to pay to remove the trees that are in danger of falling? Something tells me that if they fall, they'd be my responsibility. I've always done the maintenance. Fortunately it's not a large piece of land.

I can tell you right now that my wife has never been called a b!tch by any of my neighbors to her face and that’s because she minds her own business and isn’t messing with anyone. This lady messed with the wrong neighbor and now wants to cry victim. Oh no…Her husband travels internationally for work and she’s scared?! BS! If I was on that jury the Plaintiff wins hands down.

I don't understand why the previous owner granted these easements to begin with. It was nice of the previous owner to allow them to extend driveway onto there property. (easement #1) But I don't understand why they case easement #2 at the end of the property and they still have to pay taxes on the land.
Imagine you get picked for jury duty only to find out it's about a petty property dispute. 😆

My God…..I’m just starting this….BUT it seems to me that both people are being shitty neighbors. My God, apparently people have more money than sense. Those attorneys are not cheap, I am certain.

Jeezis, get a hobby. We have use of an easement that our next door neighbors own that's much more vital than this nonsense–it's use of their single-width driveway, between our houses, to get to our only two parking spaces, behind our house–and we have always thought that if the owners ever said we couldn't use it anymore, that would just be our tough luck. It's crazy to throw a tantrum about a useless piece of nothing you didn't care about until yr neighbors used yr dumpster without permission. Trouble with neighbors is not something I would EVER get into on purpose.
Hope they’ve all learned the very valuable lesson that problematic neighbors cause far too much grief. First place I bought (and was so excited about for a whopping week) was a second floor condo. I finally meet my neighbor a week into living there and he’s about 15 years or so older than me also Single. I introduced myself and he doesn’t but asks if I stay up late. Yes, sometimes, I said. He states that’s a big problem for him bc he can hear me walk. I’m 5’8” and all of a buck thirty and go out of my way to be quiet, including walking softly, not heavy footed. So I told him until I learn to levitate he’ll just have to live with it bc it’s an unreasonable expectation that I keep the same hours as him. Oh hell! You’d have thought I kicked him between the legs. From then on out it was war! He abused 911 so much the cops put in a code to not respond to my home when he’d call bc they’d been out with no findings so many times and knew what was going on plus dude was always drunk so didn’t help his position. Oh wait – it gets better. Somehow, bc God has an awesome sense of humor and retribution, this jerk ends up on a fishing trip with my Dad (my Dad knew about my problems with him and my sister witnessed a couple instances and told him as well). So they’re sitting around drinking one night and dude launched into stories about his snotty B neighbor. My Dad cues in this may be my neighbor and asks what kind of car this girl drives. Dude says red Camaro lol and my Dad said that’s my daughter you SOB and you want to be a tough guy and harass a 24 yo single woman, come at me. Drunk dude took my Dad up on that and was very sorry he did. Needless to say, that ended all problems with dude and he moved back home with Mommy shortly thereafter.
Pretty cut and dry.. if the easement is in place. The one who blocked it is in the wrong
