  1. Wait,…. yima Justice Theron. She was to a larger extent, agitated and impatient. I don't want to say lack of "emotional intelligence", given that she is a Judge.🤣🤣😛

  2. Let me salute Adv Dali Mpofu for the powerful defence he gave the Constitutional Court. In fact, He was schooling them, look how Justice Mathopo concealed when Adv Mpofu requested him to refer again and that he would never come across such a section. Mpofu came out gun blazing when he emphasised "section 35, the Bill of Rights" section. He dismantled the IEC and worse he professionally exposed Commissioner Janet Love, on how she was biased and highly conflated in this matter.

  3. Dali's argument about eligibility and who has the power to disqualify,and that it is the National Assembly who has those powers on the day of swearing, is totally wrong and misplaced …otherwise there would be no need for prerequisite and objections period in the process

  4. I'm very much impressed by Mpofu, his submissions are clearly stated. He schooled everyone in this court. And indeed I forsee a dismissal of the appeal with costs

  5. So hard to follow Mpofu. ……He just waffles and doesn't ever answer the questions directly. On the other hand, his counterparts provide clear and concise legal arguments. I predict another loss coming his way….

Adv Mpofu SC(The people’s advocate )and Adv Ngcukaitobi SC(The land’s advocate ) are the CR7 and Messi of SA law 🔥⭐️ and that Yong man Adv Kasi boto is the Haarland or Mbappe of SA law 🤞🏽the next big thing in SA law ..EFF✊🏽…Black Excellence 🙏🏽this not an easy case but I think Mpofu is on fire lately and has argued this case better :1 IEC has no mandate as per our constitution Ngcucaitibi argued with criteria to for National Assembly which is not IEC’s role ..IEC has powers to decide who stand for elections not National Assembly :if they want Zuma’s head they rather get it at that level not now .2.remission as per all possible definition including in our constitution ,clearly deals with the duration of sentencing issue ….although the ConCourt might have to suffer their old blunders like sentencing Zuma without trial .i find it difficult for ConCourt to find agains Zuma this time arround 🤞🏽Weldone Gentlemen most will learn a lot from you

  8. Adv Nguckaitobi is a esteemed legal behemoth. Should he have not given the clear cut case to a young black upcoming women purely to demonstrate their own abilities.

    It would serve him well in his future application to the Constititual court

  10. It's a pity that Adv Mpofu sought to assist Justice Theron with the difficulty she expresses at 9:47:00. Again, he should have simply told her that her difficulty is a direct consequence of the anomalous and highly contentious decision of the CC to convict and sentence a person to imprisonement as a court of first and last instance. What these justices are failing to appreciate is that such an act by the CC was bound to introduce near-insuperable complications into our jurisprudence. They cannot sit there perplexed at the complications that arise, and expect Adv Mpofu to carry the burden of dissolving them.

  11. It's a pity that Adv Mpofu sought to ease Justice Tshiqi's discomfort expressed at 8:55:45. He should have simply said, "Well, that's a direct consequence of a person being 'convicted' and 'sentenced' without being afforded their constitutional rights.

  12. Black individuals will shock you when a man like Ngcukathombi is not arguing one of their bias crapshoot. Yet, when one of our brilliant legal minds deftly navigates the intricacies of law, some are quick to label him as arrogant. However, beneath this facade lies a deeper truth: it's not arrogance they despise, but rather his intellect. We've witnessed similar unfounded attacks on Judge Ngcukathombi during his tenure, particularly in cases as sensitive as those involving rape. Let's acknowledge the undeniable talent of such individuals. They excel not only in cases where ignorance is not a bias but also in challenging the assumptions of armchair critics who dare to think they can outsmart them in their own imagined realms.

To argue that the remission of the President didn't effect the sentence of President Zuma, is too narrow an argument and negates the constitutional principle that constitutional provisions must be interpreted in favour of individuals and protection of human rights and not in favour of sentencing provisions, which limit rights. Remission is a legitimate exercise of power which had the effect of placing President Zuma outside of the 12 month limitation which disqualifies a candidate, in my respectful view.

Adv T Ngcukayitobi summarised the law or legal position very crispy and clear to the point and high relevant issues touched with clarity of note…I was not surprised that the whole bench didn't have any questions…I hope all lawyers take that address to heart coz the bench doesn't get bored with u and clarity prevails…11/5/2024

  15. Mpofu has mastered the art of talking for a lengthy period of time without substance. He is 70% politician and 30% advocate. He will bankrupt that Zuma family if he hasn’t done so already.

  16. Whether I like it or not Im bound by the unanimous decision of this Court in terms of the principle of “stare decisis”, that puts the nail in the coffin to the respondent’s case Justice Mathopo… 😂😂😂
