Imhotep, with all due respect, when you asserted that the Haitian refugees, who sought asylum in Jamaica, entered Jamaica illegally, your assertion was erroneous. You made this assertion/distinction. You use international laws to support your arguments and though applicable to Michelle Clarke's argument, you ignored the international laws that supported her argument Haitians went to Jamaica seeking asylum and they were not afforded due process—commensurate with international laws.
International law stipulates that asylum seekers are legally authorized to enter into other countries when seeking safety. Wherein, their asylum requests ought to be considered. This is known as the principle of non-refoulement, which is part of human rights law and customary international law. Non-refoulement states that countries cannot return asylum seekers to situations where their lives or freedoms would be in danger.
Per the UN: “That said, there are situations where UNHCR may be the one examining asylum applications. This applies when a state is not a party to the 1951 Refugee Convention or does not have a fair and efficient national asylum procedure in place. When a person applies for asylum or refugee protection, the State will determine whether the person is a refugee. The State will protect the person against refoulement, permit the person to remain on the territory and provide access to humane standards of treatment and to a durable solution. They thus fall within the internationally recognized definition of “refugees” with access to assistance from States.”
Per the UN: “According to international refugee law, it's not illegal for refugees to cross borders irregularly to reach safety. States are obligated to ensure that refugees can access their territory and seek asylum, and they shouldn't penalize refugees for crossing borders without authorization or required documents.”
Per the UN: “States have specific obligations towards refugees under international law, including:
• Ensuring refugees can access their territory and seek asylum.
• Not penalizing refugees for crossing borders irregularly (without authorization or required documents) to reach safety. There is nothing illegal about seeking asylum.”
